The latest Immigration and Customs Enforcement (ICE) raid this week was part of what one official called "a nationwide effort to shut down the employment magnet fueling illegal immigration."
- Mississippi Raid: 595 suspected undocumented workers were arrested at an electrical equipment plant on evidence relating to identity theft, fraudulent use of Social Security numbers and other crimes. The arrest of the workers reportedly shut down operations.
- Identity theft occurs when someone uses another person’s identifying information, such as a Social Security Card, Green Card, driver’s license or passport, to commit fraud or other crimes.
- It is unlawful for employers to knowingly accept any forged, counterfeited or altered identity document. Violation of the law exposes employers to sanctions under the Immigration Act.
Hiring managers are not expected to be experts in detecting fraudulent documents but they are required to examine documents provided by the employee to determine whether the documents appear genuine and relate to the employee who presented them. Here’s what managers can do:
- Use E-Verify: The Dept. of Homeland Security’s free, internet-based employment verification system allows employers to verify the work authorization of new hires. To sign up: E-Verify Employer Registration.
- Photo Tool: Based on information entered into E-Verify by the employer, E-Verify returns an official image stored in government data bases for the employer to compare to the Green Card or Employment Authorization Document presented by the employee. The employer decides if the photos match, taking into consideration such factors as aging.
- Green Cards: Hiring managers should be aware Permanent Resident Cards (Green Cards) have been issued in several different formats over the years to combat document fraud.
