- Colo. Dept. of Labor Audits: The state is conducting 20 random audits of employers weekly to review Colorado Affirmation of Legal Work Status forms and documents.
- Employer Fines: Companies who fail to submit proper documents or submit false documents face fines of up to $5,000 for the 1st offense and up to $25,000 for other offenses.
WHAT’S THE COLORADO AFFIRMATION FORM?
In addition to completing the federal Form I-9, employers must meet Colorado Employment Verification Law requirements by completing the Colorado Affirmation form for all new hires after Jan. 1, 2007.
WHAT EMPLOYERS MUST DO:
Within 20 days of new hire, employer must show these requirements have been fulfilled:
- Examined the work status of new hires
- Maintained copies of required Form I-9 identity documents
- Not altered or falsified identity documents provided by the employee
- Not knowingly hired an illegal alien.
- Retained copies of the Colorado Affirmation of Legal Work Status Form for new hires.

- State Audit: Maintain copies of identity documents separate from the Forms I-9. In case of an audit, Colorado agents may view only Colorado Affirmation records. Only federal agents have the authority to view Form I-9 records.
